Terms of Use

Effective Date: October 7, 2025

Welcome to the Pelicano Popoyo website. By accessing or using our website, you agree to these Terms of Use.

1. Reservation & Payment

A booking is confirmed upon receipt of a 50% deposit and written confirmation from Pelícano Popoyo.

The remaining 50% balance must be paid no later than 14 days prior to arrival.

For international guests, payment is primarily accepted via international bank transfer unless otherwise agreed.

Failure to complete payment within the required timeframe may result in automatic cancellation of the reservation without refund of the deposit.

2. Cancellation Policy

• The 50% deposit is refundable only if cancellation is made 31 days or more prior to arrival.• Cancellations made within 30 days of arrival result in forfeiture of the deposit.• Within 15 days of arrival, 100% of the total stay amount is non-refundable.

No credits or date transfers are guaranteed.

We strongly recommend that guests purchase travel insurance.

3. Security Deposit

Pelícano Popoyo does not require a formal security deposit; however, guests remain financially responsible for any damage to the property beyond normal wear and tear.

4. Occupancy & Visitors

Maximum occupancy limits must be respected at all times.

Each villa may receive up to two (2) non-overnight visitors, who must leave the property no later than 10:00 PM.

Events, parties, or unauthorized gatherings are strictly prohibited.

Children are counted as full occupants.

Pets are permitted only upon prior approval and signature of the Pet Agreement. Additional conditions apply.

5. Property Use & Conduct

Guests agree to use the property responsibly and in accordance with provided house guidelines.

Pelícano Popoyo reserves the right to terminate a stay without refund in cases of:

• Excessive disturbance• Illegal activity• Violation of occupancy rules• Damage to the property

6. Liability Disclaimer

Guests acknowledge that:

• Travel involves inherent risks• Ocean conditions may be unpredictable• Road access to the property includes unpaved surfaces• Infrastructure conditions in Nicaragua may differ from their home country

Pelícano Popoyo is not liable for:

• Accidents occurring inside or outside the property• Injuries related to surf or ocean activities• Road-related incidents• Theft or loss of personal belongings• Power interruptions

The property is equipped with a backup generator, which may be operated at the discretion of management.

7. Third-Party Services & Experiences

Pelícano Popoyo may coordinate transportation, wellness services, surf instruction, tours, or other experiences through independent third-party providers.

All such services are operated by external providers.

Payments for coordinated services may be processed through Pelícano Popoyo.

However, Pelícano Popoyo assumes no liability for:

• Injury• Accidents• Service interruptions• Cancellations• Quality of service• Loss or damages

Participation in third-party activities is at the guest’s own risk.

8. Limitation of Liability

To the fullest extent permitted by law, Pelícano Popoyo shall not be liable for indirect, incidental, or consequential damages arising from a reservation or stay.

Financial liability, if any, shall not exceed the total amount paid for the accommodation.

9. Relocation Clause

In the unlikely event that the reserved villa becomes unavailable due to circumstances beyond control (force majeure, structural damage, safety issue), Pelícano Popoyo reserves the right to:

• Offer comparable alternative accommodation, or• Issue a refund of payments received, which shall constitute full settlement of liability.

10. Right to Refuse Service

Pelícano Popoyo reserves the right to refuse or cancel a reservation at its discretion if it believes the stay may pose risk to the property, staff, or neighboring properties.

11. Use of Guest Images

Guests who share images, videos, or content publicly on social media and tag Pelícano Popoyo grant permission for reposting unless explicitly requested otherwise in writing.

Pelícano Popoyo will not use private images without consent.

12. Governing Law & Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through written communication in good faith.

These Terms & Conditions are governed by the laws of the Republic of Nicaragua.
